It need to be laid out in stone very clearly because that's the only way rules are effective.
The rule needs to specify that IC permission needs to be received in all cases except for those in which it would not be logical to be sought after (Building illegally or secretly) in which case OOC permission may stand in for IC permission, as the character would not be inclined to ask.
If everyone looked for OOC permission first you're still taking roleplay out of the server. If someone asks for OOC permission and then gets turned down, there isn't any roleplay in that. One character asking / badgering another for permission to build within city limits -is- roleplay however, and could lead to different outcomes.
